1. About GetNear

GetNear is a nearby social network that helps users connect with people, professionals, businesses, posts, and local information around them.

GetNear may include features such as:

• User profiles
• GetNear Profile ID
• Nearby people discovery
• Skill and profession-based search
• Business discovery
• Posts, images, videos, comments, reactions, reports, and sharing
• Messaging and communication features
• Availability status
• Location-based distance and reach
• Notifications
• SOS or emergency-related supportive features
• Beta testing and feedback features

Some features may be available only in beta, testing, limited release, or future versions.

2. Eligibility

By using GetNear, you confirm that:

• You are legally allowed to use this type of app in your location.
• You will use the App only for lawful and responsible purposes.
• If you are under 18 years of age, you will use GetNear only with appropriate parent, guardian, or institution-approved permission where required.
• You will not use GetNear for illegal, unsafe, abusive, fraudulent, misleading, or harmful activities.

We may restrict, suspend, or terminate access if we believe your account or activity violates these Terms or applicable law.

3. Account Registration and Phone Verification

To use GetNear, you may need to create an account using your phone number and OTP verification.

You agree that:

• You will provide accurate and current information.
• You will not use someone else's phone number, identity, photo, or profile information without permission.
• You are responsible for keeping your device and account safe.
• You will not share OTPs, verification codes, or login details with others.
• We may use security checks such as Firebase Authentication, App Check, Play Integrity, device/session verification, or similar tools to protect the App from fake accounts, spam, abuse, and unauthorized access.

We may refuse, suspend, or remove accounts that appear fake, abusive, fraudulent, unsafe, or in violation of these Terms.

4. User Profile and GetNear Profile ID

Users may create a profile containing information such as name, title, gender, profile photo, skill, profession, business details, short introduction, verification status, and GetNear Profile ID.

Your GetNear Profile ID is used to identify your profile inside GetNear.

You agree that:

• You will not impersonate another person, business, organization, or public figure.
• You will not misuse another user's GetNear Profile ID.
• You will not create fake or misleading profiles.
• You are responsible for the accuracy and legality of the information you add to your profile.

5. Location-Based Features

GetNear uses location-based features to show nearby users, professionals, businesses, posts, and local discovery results.

You understand and agree that:

• Location and distance information may be approximate.
• Distance may be calculated as straight-line distance and may not represent road distance, travel time, or actual route.
• Availability ON/OFF settings may affect whether you appear in nearby results.
• If location permission is disabled, some nearby, distance, post reach, and SOS-related features may not work properly.
• GetNear is designed for nearby discovery and local connection, not for exposing exact live location publicly.

You can control location permission through your device settings.

6. Posts, Comments, Media, and User Content

Users may create posts, upload images or videos, comment, reply, react, report, and share content.

You retain ownership of the content you create. However, by posting content on GetNear, you grant GetNear a limited, non-exclusive, worldwide license to host, store, display, process, transmit, and show your content within the App and related services for operating, improving, and promoting GetNear.

You agree not to post, upload, send, or share content that:

• Is illegal, abusive, threatening, hateful, defamatory, harassing, or discriminatory
• Contains violence, exploitation, sexual abuse, or harm toward minors
• Shares someone's private information without permission
• Contains fake, misleading, fraudulent, or impersonation-based information
• Promotes scams, spam, malware, hacking, or unauthorized access
• Violates copyright, trademark, design rights, privacy rights, or any other legal rights
• Encourages unsafe behavior, illegal services, drugs, weapons, fraud, or harmful activities
• Contains sexually explicit, obscene, or highly offensive material
• Creates safety risks for other users or the public

We may remove, limit, hide, or restrict content that violates these Terms, community safety, platform policy, or applicable law.

7. Messaging, Calls, and Communication Features

GetNear may provide messaging, call, or communication-related features between users.

You agree not to use communication features for:

• Harassment, threats, stalking, bullying, or abuse
• Spam, scams, fake offers, or misleading promotions
• Sharing illegal, harmful, explicit, or abusive content
• Collecting personal information from others without permission
• Impersonation, fraud, blackmail, or intimidation

We may restrict messaging, calls, or communication features if we detect misuse, repeated reports, suspicious activity, or policy violations.

8. Verification and Trust Features

GetNear may offer verification features such as profile verification, photo verification, ID verification, DigiLocker, Aadhaar-based verification, or similar methods where available.

Verification badges or verification statuses are intended to improve trust, but they do not guarantee that a user is safe, honest, legally qualified, professionally licensed, or suitable for any interaction, service, job, transaction, or meeting.

Users should use their own judgment before meeting, hiring, contacting, paying, trusting, or sharing personal information with anyone found through GetNear.

9. Business and Professional Listings

GetNear may allow users, professionals, or businesses to create profiles, listings, posts, and service-related information.

Business owners and professionals are responsible for ensuring that their information, qualifications, licenses, pricing, claims, offers, and services are accurate and lawful.

GetNear does not guarantee the quality, legality, availability, safety, pricing, qualification, or reliability of any professional, business, product, or service listed in the App.

Any transaction, service, meeting, payment, or agreement between users is solely between those users.

10. SOS and Emergency-Related Features

GetNear may include SOS or emergency-related supportive features.

These features are provided only as supportive tools. They are not a replacement for official emergency services, police, ambulance, fire services, hospitals, government helplines, or local authorities.

In a real emergency, users should immediately contact the official emergency number or local authorities.

GetNear does not guarantee emergency response, rescue, medical help, police action, real-time assistance, or successful delivery of SOS-related alerts.

11. Reports, Blocking, and Moderation

Users may report posts, profiles, comments, messages, or behavior that appears abusive, unsafe, fake, illegal, or inappropriate.

GetNear may review reports and take action, including:

• Removing or hiding content
• Restricting content visibility
• Suspending or deleting accounts
• Limiting communication features
• Blocking users from interacting
• Preserving records for safety, legal, or fraud-prevention reasons
• Cooperating with lawful requests from authorities

We are not required to monitor all user content continuously, but we may moderate content when necessary.

12. Beta Testing and Early Access

If you use a beta, closed testing, internal testing, or early access version of GetNear, you understand that:

• The App may contain bugs, incomplete features, design changes, or performance issues.
• Features may change, be removed, or stop working during testing.
• Test data may be reset, deleted, or migrated where necessary.
• Feedback may be collected to improve the App.
• Beta access does not guarantee future access to the final public version.

By participating in beta testing, you agree to use the App responsibly and provide honest feedback where possible.

13. Acceptable Use

You agree that you will not:

• Break any applicable law or regulation
• Create fake accounts or impersonate others
• Use bots, scraping, scripts, automation, or unauthorized tools
• Attempt to hack, reverse engineer, overload, damage, or disrupt GetNear
• Upload malware, harmful code, or malicious files
• Misuse location, profile, chat, post, report, or SOS features
• Harass, threaten, stalk, abuse, or harm other users
• Use GetNear for scams, spam, fraud, fake services, or illegal activities
• Violate another person's privacy, safety, or intellectual property rights
• Try to bypass security systems, verification, App Check, device checks, or access controls

Violation of these rules may result in content removal, feature restriction, account suspension, account deletion, legal action, or reporting to authorities.

14. Intellectual Property

The GetNear name, logo, design, interface, features, software, source code, database structure, branding, text, graphics, and related materials are owned by or licensed to GetNear.

You may not copy, modify, distribute, sell, rent, reverse engineer, clone, misuse, or create derivative works from GetNear without written permission.

User content remains owned by the user who created it, subject to the limited license given to GetNear for operating and improving the Service.

15. Third-Party Services

GetNear may use third-party services such as Firebase, Google Cloud, Google Play services, authentication providers, storage services, notification services, analytics, crash reporting, hosting, verification partners, and other technical service providers.

Your use of GetNear may also be subject to the terms and policies of those third-party services.

We are not responsible for third-party services, websites, tools, outages, data handling, or policies that are outside our control.

16. Privacy

Your use of GetNear is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect user data.

If there is a conflict between these Terms and the Privacy Policy regarding personal data handling, the Privacy Policy will apply to that issue.

17. Account Deletion and Termination

You may request account deletion through the App where supported or by contacting us.

We may suspend, restrict, or terminate your account if:

• You violate these Terms
• You misuse the App
• Your account appears fake, abusive, fraudulent, or harmful
• Your activity creates safety, legal, or security risks
• We are required to do so by law, platform policy, or lawful authority

If account deletion is requested, your account may enter a grace period before permanent deletion. Some information may be retained for a limited time where necessary for legal, security, fraud-prevention, dispute-resolution, backup, or safety reasons.

18. App Availability and Changes

We may update, modify, pause, remove, or discontinue any part of GetNear at any time.

We do not guarantee that the App will always be available, error-free, uninterrupted, secure, or compatible with every device, network, or operating system.

Some features may require internet access, device permissions, app updates, location access, notification permission, or supported device capabilities.

19. Disclaimer

GetNear is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not guarantee that:

• The App will always work without errors or interruptions
• Nearby results will always be accurate, complete, live, or safe
• Users, businesses, posts, messages, or services found through GetNear are always genuine, verified, reliable, or suitable
• Messages, notifications, location, distance, or SOS-related features will always work in real time
• The App will meet every user's expectations

Users are responsible for their own decisions, interactions, communications, meetings, services, transactions, and safety.

20. Limitation of Liability

To the maximum extent permitted by applicable law, GetNear and its developer/operator will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of business, loss of profits, personal disputes, user conduct, offline meetings, third-party actions, or damages arising from use or inability to use the App.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

21. Indemnity

You agree to defend, indemnify, and hold harmless GetNear, its developer/operator, team members, partners, and service providers from claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use or misuse of GetNear
• Your content or activity
• Your violation of these Terms
• Your violation of any law or third-party right
• Your interaction, transaction, communication, meeting, or dispute with another user

22. Governing Law

These Terms are governed by the laws of India, unless applicable consumer protection laws require otherwise.

Any dispute arising from or related to these Terms or GetNear will be subject to the appropriate courts or authorities in India, subject to applicable law.

23. Changes to These Terms

We may update these Terms from time to time.

If we make important changes, we may notify users through the App, website, Play Store listing, or other reasonable methods.

Your continued use of GetNear after changes become effective means you accept the updated Terms.
